Seven of the shots fired by MPs hit Kizzee in the back, including his arms and hands, Attorney Carl Douglas said. The fatal shot hit Kizzee in the lungs.
“He didn’t die instantly, he doubled over in pain on the floor when officers opened up to him,” said Douglas.
“You can tell by the sound of the recording that there were three or four recordings, then a break and 15 additional recordings.”
The independent autopsy was performed by Dr. John Hiserodt, who found that Kizzee bled to death after blood filled his lungs. Hiserodt believes Kizzee was shot while he was moving ̵
“MEPs who fired their guns called for assistance and waited critical minutes for support to arrive while Dijon bled to death in the street,” the statement said. “The independent autopsy supports my claim that this shooting was simply an execution.”
Douglas said the incident showed excessive violence and that Kizzee did not pose a lethal threat to anyone.
“He was shot 19 times and I don’t care what Sheriff Villanueva said to justify this lack of humanity,” replied Douglas. “Nineteen times I’ve shot a man in the body tells me there’s been poor training.”
LASD said it had no comment on the results of the private autopsy.
Last week, LASD said Homicide Bureau Capt. Kent Wegener, the coroner’s office has not finalized the autopsy report. The LA County Medical Examiner’s office confirmed earlier this month that Kizzee had died of gunshot wounds and his death was convicted of murder.
MPs tried to stop Kizzee for the first time on August 31 for “cycling on the wrong side of the road” and “sharing the traffic,” Wegener said at a press conference last Thursday. Kizzee refused to stop, parked his bike and fled on foot with a green towel in one hand and a red and black jacket in the other, he said.
Kizzee’s 9mm semi-automatic pistol, which was reported stolen in 2017, fell to the ground while meeting MPs. Wegener said Kizzee leaned over and reached back to pick up the pistol before MPs fired. The gun was loaded with 15 live rounds.
Benjamin Crump, another attorney for the Kizzee family, said last week that video footage of the incident contradicts the results of the sheriff’s department.
Kizzee’s gunfire sparked protests in a city that had raged for months after George Floyd died in police custody in Minneapolis in late May.
“It’s so fast that we can barely keep up with the hashtags,” Crump said Tuesday of black police shootings reminiscent of Floyd, Ahmaud Arbery, Breonna Taylor and Jacob Blake.
“While America is dealing with the Covid-19 pandemic, in Black America we are dealing with the 1619 pandemic.”
